Tribunal Upholds PDP Senator Osita Ngwu’s Election, Faults, Sacks Labour Party Federal Law Maker, Umeha, Declares Uzor Of PDP

The National Assembly Election Petitions Tribunal sitting in Enugu has sacked a Labour Party House of Representatives member representing Udi/Ezeagu Federal Constituency, Mr Sunday Umeha.

The Tribunal also declared the candidate of the Peoples Democratic Party in the election and the former Chief of Staff to Governor Ifeanyi Ugwuanyi, Dr Festus Uzor as the winner of the 2023 poll.

The three-member panel of Justices led by A.M. Abubakar, in declaring Uzor the winner while ruling on his petition, averred that Umeha did not properly resign from the PDP before seeking the ticket of the Labour Party.

The panel also held that even the purported resignation letter presented by Umeha, a legal practitioner, was signed by someone who was no longer a leader in the PDP.

Justice Abubakar, thereafter, ordered the Independent National Electoral Commission (INEC) to withdraw Umeha’s Certificate of Return and issue same to Uzor.

Meanwhile, the tribunal upheld the election of Osita Ngwu of the PDP as the Senator representing Enugu West Senatorial Zone.

Ngwu was returned as the winner of the February 25 poll.

Dissatisfied with the result of the election, Dennis Oguerinwa Amadi, the candidate of the Labour Party and the party had challenged the outcome of the election at the tribunal.

Ruling on the petition on Tuesday, the tribunal held that the petitioners made an error in presenting their case by merging the allegation of non-compliance with the Electoral Act with that of corrupt practices.

The tribunal held that the petitioners should have separated the two cases and particularized their facts to support both positions.

On the allegation of over-voting, the court held that the petitioners couldn’t particularize their pleadings despite bringing witnesses that gave evidence on that along with ballot papers.

The court said the ballot papers were dumped on the court with no evidence showing where the ballot papers emanated from.
